General Terms and Conditions

§ 1 Provider and Scope

The provider is Evela Health GmbH, Chausseestraße 58d, 10115 Berlin, Germany (hereinafter “Evela” or “we”). Contact: info@evela.health.

These General Terms and Conditions (GTC) apply to the purchase of the Evela Sleep Course via our website or landing page. For the use of the Evela user account created in this process and of the Evela app, our Terms of Use (App/Platform) apply in addition.

§ 2 Subject Matter of the Contract

The Evela Sleep Course is a certified, digital prevention course on the topic of sleep during menopause (a course pursuant to Section 20 SGB V [German Social Code Book V], certified by the Central Testing Office for Prevention – ZPP). The course runs over a period of nine weeks; this course period cannot be shortened.

The purchase price additionally includes the Evela Clarity service (a detailed health assessment and a personal video consultation).

§ 3 Conclusion of Contract

The sleep course is offered via our landing page. By providing your e-mail address, confirming the mandatory checkboxes (privacy policy and these GTC) and clicking the “order with obligation to pay” button, you submit a binding offer to purchase the course. The contract is concluded upon our confirmation (order confirmation by e-mail).

Purchase is permitted to persons who are at least 18 years old and have full legal capacity.

§ 4 Prices and Payment

The sleep course is offered as a one-time purchase at a price of €99 (incl. statutory VAT). It is not a subscription; there are no follow-up costs and no automatic renewal.

Payment is processed via our payment service provider Stripe (Stripe Payments Europe, Ltd., Ireland). You receive a purchase confirmation or invoice that you can submit to your health insurer.

§ 5 Automatic Account Creation

After a successful purchase, your e-mail address is automatically stored with us. On your first visit to the web app or the mobile app, you can register — or complete your registration — using your e-mail address and the one-time code (OTP) sent to you, and thereby access the purchased course and the included services.

§ 6 Provision of the Course and Course Access

The sleep course is technically provided via our partner Thepalia. You start the course from your Evela account via a magic link, without having to register separately with Thepalia; the course is displayed within the Evela interface.

Access to the course content is available to you for six months from purchase. After completing the course, you receive a participation/completion certificate and the accompanying course documents.

§ 7 Reimbursement by the Health Insurer

As a prevention course pursuant to Section 20 SGB V, the partial or full reimbursement of the course price is made by your statutory health insurer after successful completion of the course. Whether and to what extent reimbursement is made depends exclusively on the terms of your insurer. Evela provides you with the required invoice and participation certificate, but assumes no guarantee of reimbursement. For persons with private insurance, there is no entitlement to reimbursement of certified prevention courses. Many private insurers reimburse prevention courses on a goodwill basis; it is worth asking.

§ 8 Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal. We inform you of this with the following withdrawal instructions:

Withdrawal Instructions

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract. To exercise your right of withdrawal, you must inform us (Evela Health GmbH, Chausseestraße 58d, 10115 Berlin, info@evela.health) by means of a clear statement (e.g. by e-mail) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal: If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this repayment, we use the same means of payment that you used for the original transaction; in no case will you be charged any fees for this repayment.

End of withdrawal instructions.

Exception for digital content: As soon as you have started viewing or using the course content, your right of withdrawal expires.

With a withdrawal, the basis for reimbursement by your health insurer ceases to apply; a purchase confirmation/invoice already issued may then not be submitted for reimbursement. Withdrawal and simultaneous insurer reimbursement are mutually exclusive – submitting nonetheless may be punishable as fraud (Section 263 of the German Criminal Code, StGB).

§ 9 Upgrade to Evela Premium

Within six months of purchase, the price of the Evela Sleep Course is credited once toward the price of an upgrade to Evela Premium.

§ 10 Liability and Health Notes

Participation in the sleep course is at your own responsibility. The course serves general information and prevention and does not replace medical examination, diagnosis or treatment. In case of health complaints, please consult a doctor.

Evela is liable only in the following cases: in the event of intent and gross negligence, in the event of injury to life, body or health, as well as under the German Product Liability Act and in other cases of mandatory statutory liability. In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), Evela is liable limited to the typical, foreseeable damage. Any liability beyond this is excluded.

§ 11 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.

Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.

Evela does not participate in dispute resolution proceedings before a consumer arbitration body. There is no legal obligation to do so.
